Stages and timelines of registration

The trademark registration process consists of several stages, each with its own established timelines.

1. Formal examination

Timeline: 1-2 months

At this stage, the correctness of the application, the completeness of the documents and the payment of official fees are verified. If deficiencies are found, an inquiry is sent with a two-month period for a response.

2. Publication of the application

Timeline: within a month after the formal examination

Information about the application is published in the official bulletin of Rospatent.

3. Substantive examination

Timeline: 6-12 months

The longest stage. Examiners check the mark for compliance with the requirements and the absence of similarity to previously registered marks.

4. Decision and registration

Timeline: 1-2 months

After a positive decision, the official fee for registration is paid, and the mark is entered into the register.

Expedited registration

Since 2022, Rospatent has offered an expedited examination service. It allows the overall registration timeline to be shortened to 2-4 months.

Conditions of the expedited procedure:

• Additional official fee (about 95,000 rubles per class)
• A flawlessly prepared application without errors
• Preliminary search of the mark

When to choose expedited registration:

• Launch of a new product or brand
• Participation in tenders that require a certificate
• Conflict with a competitor over a mark
• Raising investment

What affects the timelines

• Quality of the application — errors lead to inquiries and extend the timeline
• Number of classes — more classes = a longer review
• Similarity to other marks — correspondence with the examiner may be required
• Rospatent workload — during periods of high load, timelines increase
